1. The Judges shall, immediately after the partial replacement provided for in Article 224 of the EC Treaty and Article 140 of the EAEC Treaty, elect one of their number as President of the Court of First Instance for a term of three years. 2. If the office of President of the Court of First Instance falls vacant before the normal date of expiry thereof, the Court of First Instance shall elect a successor for the remainder of the term. 3. The elections provided for in this Article shall be by secret ballot. If a Judge obtains an absolute majority he shall be elected. If no Judge obtains an absolute majority, a second ballot shall be held and the Judge obtaining the most votes shall be elected. Where two or more Judges obtain an equal number of votes the oldest of them shall be deemed elected.
